hen faced with enforcement or a serious safeguarding issue often managers and proprietors are not provided with information from the regulatory authorities on how to be compliant. It is essential that managers and proprietors put the issue right first time to prevent further escalation. Under the new regulations, CQC have a wide range of enforcement powers we can take using the criminal and/or civil procedures in the Health and Social Care Act 2008 and relevant regulations. |
They can take the following action:
- issue a warning notice.
- impose, vary or remove conditions.
- issue a penalty notice instead of prosecution.
- prosecute for specified offences.
- suspend registration.
- cancel registration.
If you have recently had an inspection and the inspectors have found moderate or major concern. it is important to ensure full compliance to prevent enforcement action which can have devastating consequence.
